Welcome to JDCELearn (“the App,” “we,” “our,” “us”), the official learning platform of the Engr. Jobert De La Cruz YouTube Channel, offered exclusively as part of the channel’s membership program. JDCELearn.com is a proposed online learning platform aimed at complementing the learning of Civil Engineering students and strengthening their preparation for the board exams. The platform will offer pre-recorded video lectures, mock exams, and downloadable review materials—all authored and curated by Engr. Jobert S. De La Cruz.
These Terms and Conditions (“Terms”) govern your access to and use of JDCELearn’s online learning platform, including our website, mobile application, educational content, and related services (collectively, the “Services”). By accessing or using JDCELearn, you agree to be bound by these Terms. If you do not agree, you must discontinue use of our Services.
We may update or modify these Terms from time to time. You will be provided with prior notice of any scheduled changes to the Services you are using. Unless otherwise stated, changes to these Terms will take effect ten (10) days after notice is given. However, updates relating to new features, security enhancements, or bug fixes will take effect immediately upon release.
By continuing to use the Services after the effective date of any changes, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you may discontinue your use of the Services in accordance with the section “Term and Termination” below.
You must be at least 18 years old to use JDCELearn. If you are under 18, you may only use the Services with the consent and supervision of a parent or legal guardian.
For your reference, we recommend that you save or print a copy of these Terms and Conditions for your personal records.
1. Our Services
The information and content provided through the Services are intended solely for users in jurisdictions where such access and use are legally permitted. The Services are not intended for distribution to, or use by, any person or entity in any country or jurisdiction where such distribution or use would be contrary to law or regulation, or which would subject JDCELearn to any registration, licensing, or other legal requirements.
Individuals who choose to access the Services from locations outside of our intended jurisdiction do so on their own initiative and are solely responsible for ensuring compliance with all applicable local laws and regulations.
2. Intellectual Property
Our Intellectual Property
All content provided through JDCELearn—including but not limited to videos, lecture notes, practice exams, graphics, logos, source code, databases, software, website designs, audio, text, photographs, and other materials (collectively, the “Content”)—is the property of JDCELearn or its licensors and is protected by applicable intellectual property and copyright laws.
Users are granted a limited, non-exclusive, non-transferable license to access and use the Content strictly for personal educational purposes.
Any copying, recording, reproduction, distribution, modification, or public display of the Content, in whole or in part, without the prior written consent of JDCELearn, is strictly prohibited and may result in legal action, as well as suspension or termination of access to the Service.
Use of Service
Subject to your compliance with these Legal Terms, including the “Prohibited Activities” section below, we grant you a limited, non-exclusive, non-transferable, and revocable license to:
- Access and use the Services;
- Download or print portions of the Content that are expressly made available for download; and
- Use such Content solely for your personal, non-commercial educational purposes.
Except as expressly permitted above, no part of the Services or Content may be copied, reproduced, modified, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our prior written consent.
Any violation of these intellectual property rights will be deemed a material breach of these Legal Terms and will result in the immediate termination of your right to use the Services.
Your Submissions and Contributions
Please review this section carefully, together with the “Prohibited Activities” section, to understand:
(a) the rights you grant to us, and
(b) the responsibilities you assume when posting, uploading, or otherwise sharing content through the Services.
Submissions
By submitting any questions, comments, suggestions, ideas, feedback, or other information regarding the Services (“Submissions”), you hereby assign to us all intellectual property rights in such Submissions. You acknowledge and agree that we will own these Submissions and may use, reproduce, modify, adapt, publish, distribute, or otherwise exploit them for any lawful purpose, commercial or otherwise, without acknowledgment, notice, or compensation to you.
Contributions
The Services may allow you to participate in interactive features such as chats, blogs, message boards, community hubs, forums, or similar platforms (“Contributions”). Contributions may include, but are not limited to, text, writings, videos, audio recordings, photographs, graphics, comments, reviews, ratings, suggestions, personal information, or other materials that you create, submit, post, display, transmit, publish, or distribute through the Services.
Any Submission that is publicly posted shall also be considered a Contribution. You acknowledge and agree that Contributions may be visible to, and accessible by, other users of the Services, and that you are solely responsible for any content you choose to share.
By posting or submitting Contributions, you grant JDCELearn a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and otherwise make your Contributions available in connection with the operation, promotion, and improvement of the Services.
For clarity, you retain ownership of any intellectual property rights in your Contributions. However, you acknowledge that once Contributions are made publicly available through the Services, we cannot control how other users may use or share them, and we are not responsible for any misuse by third parties.
We reserve the right, but not the obligation, to monitor, review, screen, edit, or remove any Contributions at our sole discretion, without prior notice, if we believe they violate these Terms, infringe on intellectual property rights, or are otherwise harmful, offensive, unlawful, or inappropriate. We also reserve the right to suspend or terminate your access to the Services for repeated or serious violations.
Copyright Infringement
By posting or uploading Contributions, you represent and warrant that you own or have obtained the necessary rights, licenses, or permissions to share such materials, and that your Contributions do not infringe on any third-party copyrights, trademarks, or other intellectual property rights.
We reserve the right to remove any content that we believe, in our sole discretion, may infringe upon the rights of others or violate applicable intellectual property laws. If you believe that any material on JDCELearn infringes your copyright, you may notify us by contacting delacruzengineering@gmail.com with sufficient details to identify the copyrighted work and the allegedly infringing material.
Upon receipt of a valid notice, we will review the claim and, if appropriate, promptly remove or restrict access to the allegedly infringing material. We may also take additional action, including the suspension or termination of accounts belonging to repeat infringers.
Knowingly submitting false claims of infringement is strictly prohibited and may subject you to liability for damages under applicable law.
3. User Representation
By using the JDCELearn website or app, you represent and warrant that:
- Eligibility – You are at least 18 years old, or you are using the Services with the consent and supervision of a parent or legal guardian.
- Membership Requirement – You have a valid Level 4 membership with the Engr. Jobert S. De La Cruz YouTube Channel, and you are signing in with the correct Google account linked to that membership.
- Accuracy of Information – All information you provide during registration and use of the Services is true, accurate, current, and complete, and you will update such information as necessary.
- Lawful Use – You will use the Services only in compliance with these Terms and all applicable laws, regulations, and academic integrity standards.
- Authority – You have the legal capacity and authority to enter into and comply with these Terms.
- Non-Competition – You will not use JDCELearn for any purpose that competes with, disrupts, or harms the platform, its content, or its community.
If you provide false, inaccurate, outdated, or incomplete information, or otherwise breach these representations, JDCELearn reserves the right to suspend or terminate your account and deny you access to the Services.
4. User Registration and Access
Membership Requirement
Access to the JDCELearn website and app is provided free of charge; however, it is exclusively available to users with an active Level 4 membership on the Engr. Jobert S. De La Cruz YouTube Channel.
Registration and Login
To use the JDCELearn platform, you must sign in using the same Google account linked to your Level 4 YouTube membership. This ensures verification of your membership status and grants access to the platform.
Account Responsibility
You are solely responsible for maintaining the confidentiality and security of your account credentials, as well as for all activities conducted under your account. JDCELearn shall not be held liable for any unauthorized access, use, or account compromise resulting from your failure to safeguard your login information.
Account Restrictions
Account sharing, transfer, or resale of login credentials is strictly prohibited.
Violation of this policy may result in the immediate suspension or termination of access to the Services without notice or refund.
Each account is permitted to access the Services on one device at a time. Simultaneous logins from multiple devices using the same account are not allowed and may trigger automatic restrictions.
Fees and Payment Processing
Membership fees, payment methods, and billing cycles are determined and disclosed directly by YouTube at the time of purchase.
Payments are processed through YouTube’s platform, and you agree to comply with their payment terms and policies.
JDCELearn does not directly process payments and is not responsible for payment errors, declined transactions, or billing disputes with YouTube.
Auto-Renewal and Cancellation
Unless otherwise stated, Level 4 memberships are typically auto-renewed by YouTube at the end of each billing cycle.
You are responsible for managing or canceling your membership directly through your YouTube account settings if you no longer wish to continue your subscription.
The expiration of your YouTube Level 4 membership will result in the immediate loss of access to JDCELearn Services. If you choose to cancel your membership prior to the renewal date, you will continue to enjoy your membership perks, including access to JDCELearn, until the current billing period expires.
Refund Policy
All payments are final and non-refundable, except where required by applicable law or explicitly provided under YouTube’s refund policies.
JDCELearn does not process payments directly and therefore cannot issue refunds under any circumstances. All membership transactions, including billing and refund requests, are managed solely through YouTube/Google.
If you wish to request a refund or resolve a billing issue, you must do so by contacting YouTube or Google Support directly and following their refund procedures.
Price Changes
Membership fees are set and managed through our YouTube Channel and may be adjusted at any time at our sole discretion.
Any changes in pricing will be communicated in advance, including through official announcements on our YouTube Community Tab or other authorized communication channels.
Your continued use of the Services after such pricing changes take effect will constitute your acceptance of the revised membership fees.
Prohibited Use of Paid Content
The unauthorized distribution, resale, sharing, recording, or reproduction of JDCELearn content—including but not limited to video lectures, mock exams, and community resources—is strictly prohibited. Any such violation may result in:
- Immediate suspension or termination of access to the Services, without refund; and/or
- Legal action for infringement of intellectual property rights.
5. Prohibited Activities
When using the JDCELearn website or app, you agree not to engage in any of the following activities:
Account Misuse
- Sharing, selling, transferring, or otherwise providing access to your account or login credentials to others.
- Attempting to access the Services using another user’s account without permission.
- Attempting to impersonate another user, individual, or entity, or using another user’s username without authorization.
Misuse of Content
- Copying, recording, downloading (unless explicitly permitted), reproducing, redistributing, or publicly displaying any JDCELearn content without prior written authorization.
- Using the Services or Content for any commercial, promotional, or competitive purpose.
Inappropriate or Unlawful Conduct
- Uploading, transmitting, or posting any content that is unlawful, harmful, defamatory, obscene, offensive, or otherwise objectionable.
- Using the Services for cheating, academic dishonesty, or other fraudulent purposes.
- Engaging in harassment, hate speech, bullying, or abusive conduct toward other users or instructors.
- Attempting to trick, defraud, or mislead JDCELearn or other users, including any effort to obtain sensitive account information such as usernames or passwords.
Security Violations
- Attempting to hack, bypass, disrupt, or interfere with the security or proper functioning of the website/app.
- Introducing viruses, malware, spyware, or other harmful code into the Services.
- Uploading or transmitting (or attempting to upload or transmit) any material that functions as a passive or active information collection mechanism, including but not limited to clear graphics interchange formats (GIFs), 1×1 pixels, web bugs, cookies, or other similar technologies (commonly referred to as “spyware,” “passive collection mechanisms,” or “PCMs”).
Intellectual Property Violations
- Posting or sharing any material that infringes upon the copyrights, trademarks, or other intellectual property rights of JDCELearn or any third party.
- Misrepresenting your ownership of, or right to use, any content you submit.
Automated and Unauthorized Data Collection
- Using automated systems, bots, scripts, or similar technologies to post comments or messages.
- Employing data mining, scraping, or other automated tools to access, gather, or extract information from the Services.
- Collecting, harvesting, or otherwise misusing data from the Services, including personal information of other users, without authorization.
Legal Compliance
Engaging in any conduct that violates applicable laws, regulations, or academic integrity standards.
Consequences of Violations
Violations of this section may result in the suspension or termination of your account, removal of offending content, and/or legal action where applicable. Repeat or severe violations may result in a permanent ban from the Services without refund.
6. Guidelines for reviews
We may provide areas within the Services where you can leave reviews or ratings. When posting a review, you agree to comply with the following criteria:
- You must have firsthand experience with the person, service, or content being reviewed.
- Reviews must not contain profanity, abusive, racist, offensive, or hateful language.
- Reviews must not include discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.
- Reviews must be truthful, relevant, and not misleading, and should not be used to intentionally damage reputations.
We reserve the right to remove or refuse to post reviews that do not comply with these guidelines, and repeated violations may result in the suspension or termination of your account.
7. Service Management
We reserve the right, but not the obligation, to:
- Monitor and Moderate – Monitor the Services for violations of these Terms and Conditions and take appropriate action, including the removal or modification of content that we determine, in our sole discretion, to be unlawful, harmful, offensive, or otherwise inappropriate.
- Restrict or Suspend Access – Suspend, limit, or terminate access to the Services for any user who violates these Terms, engages in prohibited activities, or poses a risk to the integrity or security of the platform.
- Maintain Platform Integrity – Take technical, legal, and administrative steps to safeguard the Services, including actions to prevent fraud, unauthorized access, cheating, account sharing, or any misuse of JDCELearn content.
- Manage Availability – Modify, update, suspend, or discontinue any aspect of the Services at any time, including features, content, or availability, as necessary to improve functionality, address technical issues, or comply with legal obligations.
- Enforce Rights – Take appropriate legal or technical action against users who engage in conduct that infringes intellectual property rights, violates community guidelines, or otherwise breaches these Terms.
8. Privacy Policy
We care deeply about your data privacy and security. Your use of the JDCELearn website and app is subject to our Privacy Policy, which explains how we collect, use, store, and protect your personal information. Please review our Privacy Policy.
By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms.
Please note that the Services are hosted in the Philippines. If you access the Services from another region with laws or requirements governing personal data collection, use, or disclosure that differ from those in the Philippines, then by continuing to use the Services, you acknowledge and agree that your data will be transferred to, and processed in, the Philippines, and you expressly consent to such transfer and processing.
9. Copyright Infringements
We respect the intellectual property rights of others and expect our users to do the same. JDCELearn strictly prohibits the unauthorized posting, distribution, or use of copyrighted materials through the Services.
If you believe that any content available on or through the Services infringes your copyright, please notify us immediately using the contact information provided below. Your notice should include sufficient detail to identify the copyrighted work claimed to have been infringed and the material you believe is infringing.
Upon receipt of a valid notice, we will review the claim and, if appropriate, promptly remove or restrict access to the allegedly infringing material. We may also take additional action, including the suspension or termination of accounts belonging to repeat infringers.

10. Term and Termination
These Terms remain in full force and effect for as long as you use the Services.
User Termination
You may terminate your access to JDCELearn at any time by canceling your Level 4 membership through your YouTube account settings. Access to JDCELearn will continue until the end of your current billing cycle, after which it will automatically expire. No refunds or credits will be issued for early cancellation.
Our Right to Terminate
We reserve the right, in our sole discretion, to suspend or permanently terminate your account and access to the Services, without notice, if:
- You violate these Terms or engage in any Prohibited Activities;
- You misuse or infringe upon our intellectual property rights;
- Your actions compromise the integrity, security, or functionality of the Services; or
- We are required to do so by law, regulation, or legal authority.
Effect of Termination
Upon termination or expiration of your membership:
- Your license to access and use JDCELearn Services will immediately end;
- Access to all premium content and features will be revoked; and
- No refunds or credits will be provided for any unused portion of your membership.
We also reserve the right to pursue additional remedies, including legal or equitable action, in cases of serious or repeated violations.
11. Modification and Interruptions
JDCElearn reserves the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice. This includes, but is not limited to, content, features, course availability, or access to certain functionalities.
We may also update or revise these Terms of Use and related policies from time to time. Any changes will be effective immediately upon posting unless otherwise specified. It is your responsibility to review these terms regularly to stay informed of any updates. Your continued use of the platform following the posting of changes constitutes your acceptance of and agreement to be bound by those Terms.
We make no guarantees regarding the continuous availability or uninterrupted access to the platform. Temporary interruptions may occur due to maintenance, updates, or technical issues. While we strive to minimize disruptions, JDCElearn is not liable for any loss, inconvenience, or damages resulting from such interruptions.
12. Limitation of Liability
JDCE Learn provides educational content as a learning aid but does not guarantee exam results, licensing success, or professional outcomes.
JDCE Learn is not responsible for technical issues, data loss, or third-party service interruptions.
To the fullest extent permitted by law, JDCE Learn is not liable for indirect, incidental, or consequential damages arising from your use of the Services.
13. Changes to Terms
JDCELearn reserves the right to modify these Terms at any time. Any such modifications shall become effective upon posting. Continued use of the Services after the effective date of the revised Terms shall constitute your acceptance of and agreement to be bound by those Terms.
14. Disclaimer
The Services provided by JDCELearn are offered on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
JDCELearn does not guarantee that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no guarantees regarding the accuracy, completeness, or reliability of any content available through the Services.
To the fullest extent permitted by applicable law, JDCE Learn disclaims all liability for any damages, direct or indirect, resulting from your use of or inability to use the Services.
15. Indemnification
You agree to indemnify, defend, and hold harmless JDCE Learn, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
(a) your access to or use of the Services;
(b) your violation of these Terms; or
(c) your infringement of any third party’s rights, including intellectual property or privacy rights.
JDCELearn reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with such defense.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the proper courts of Mandaue City, Cebu Philippines.
17. Miscellaneous
These Terms, together with any policies or operating rules posted by us on or in connection with the Services, constitute the entire agreement and understanding between you and JDCE Learn.
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms shall be enforced to the fullest extent permitted by applicable law.
We may assign any or all of our rights and obligations under these Terms at any time without prior notice.
We shall not be held liable for any loss, damage, delay, or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, internet outages, or governmental actions.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
